Guest Edgy DC Guests Posted November 2, 2007 Posted November 2, 2007 Mets icon Ed Kranepool calls foul in funds drive Friday, November 2nd 2007, 4:00 AM Former Met Ed Kranepool is suing Long Island Jewish Medical Center for disclosing details about his successful shoulder surgery as part of a fund-raising campaign.Kranepool's photo and medical history were used without his permission last summer, causing him at least $2 million in damages, according to his lawyer Bruce Baron, who filed the suit in Brooklyn Federal Court on Tuesday. A hospital spokesman said LIJ had apologized to Kranepool and offered to refund any donations that were made in response to the letter that used his name. Kranepool, a first baseman, played for the Mets for 18 years and was a member of the "Miracle" team that won the 1969 World Series.Had he listened to Craig Swan, he'd have healed his shoulder through some serious rolfing.

The $2 million could be the least of the hospital's troubles:]Criminal Penalties. A person who knowingly obtains or discloses individually identifiable health information in violation of HIPAA faces a fine of $50,000 and up to one-year imprisonment. The criminal penalties increase to $100,000 and up to five years imprisonment if the wrongful conduct involves false pretenses, and to $250,000 and up to ten years imprisonment if the wrongful conduct involves the intent to sell, transfer, or use individually identifiable health information for commercial advantage, personal gain, or malicious harm. Criminal sanctions will be enforced by the Department of Justice.He'd have a hard time winning a suit against the forum, but if he wanted to threaten, then the name would have to change.
