Kind of a weird story, news of problems surfaced at the beginning of the
month. Why is it a cival suit? Scams usually would be kind of criminal in
my mind.

It doesn't have to be an either/or thing. There could be criminal liability as well, depending on the statutes. Generally, though, it's easier to establish civil liability than criminal liability because criminal cases require a higher standard of proof (for example, OJ was found civilly liable even though he wasn't convicted of the criminal charges).
